The article is alarmist to say the least. The FDA appears to be doing the right thing and telling them they cannot advertise things that they cannot demonstrate the truth of. Making claims is not the accepted method of demonstrating validity. There is a process for it and many, many manufacturers are proof the process can be used. The core argument that shows the article's true bias is where they say let people try to cheat others and the market will punish them sufficiently; i.e. they don't agree that the government has any protective role to play in society. I'm surprised they don't go all the way and say that these things wouldn't happen if our children were better armed.

Where on earth does it say that? Huh

And realistically the (US) Government isn't supposed to have a "Protective Role" any farther than Protecting the Nation's Borders.
(Go Look up the original Laws on it)
